摘要
罪刑法定明确性和罪状明确性、法定刑明确性的公众认同,能够得到法规范的预测可能性原则、认知心理学、心理强制说等原理学说的深切说明,但此说明应当以人权保障和秩序维护为旨趣,最终落脚在完善思路的实践方案上,包括增加叙明罪状、减少堵截条款、设置罚金标准、避免刑度过大、保持适度弹性等等。另外,专业性和通俗性应当服从并服务于明确性,这也是刑法公众认同所提出的相关题设。
The public approval to the clarity of legal prescribed crime and punishment, the definition of description about crime and legal punishment can be explained by some theory. In the meantime, it ought to be settled on the practical plan of how to improve the clarity of description about crime and legal punishment. In addition, specialty and popularity must serve for the clarity.
