摘要
南海"断续线"作为中国在南海进行权利主张的标志,如今日渐成南海争端的核心争论议题,也成为国际舆论关注的焦点。南海"断续线"是中国在特定的技术条件下提出的关于海洋划界的一种模式和主张,在国际法理层面理应得到国际社会的认可与尊重。然而,事实并非如此。南海"断续线"在公布后的对外传播中,虽然在相当长时期内并未受到任何质疑或异议,并在相关国家和国际社会的默认中实现了"历史性巩固",但在国际形势变化和南海局势持续发酵的情况下,已然成为"众矢之的",遭到东南亚菲律宾等争端方与美国等域外国家的质疑与日益增多的指责。南海"断续线"对外传播成效不佳是中国在国际舆论,特别是国际海洋秩序话语体系中处于话语弱势的结果,但这并不意味着中国的南海主张在国际法理上存在脆弱性。为此,中国应从完善海洋机制和重塑国际海洋秩序方面谋求话语权和建立优势,进而为南海"断续线"在对外传播中获得更多的国际认可创造有利条件。
The Dotted Line, as the sign of China's claims in the South China Sea, not only is the core disputed topic, but also has been focused on by the international opinion. In fact, the Line signs the view of China on the mode of maritime demarcation. Then this Line should be accepted and respected widely by the international socie- ty. However, this is not the case. The process of international communication of the Dotted Line started after its promulgation, though it was not subjected to any questions or objections in the past some decades, and made an im- plementation of historic consolidation in the situation of some other countries' default, becomes the tat-get of public: criticism and has been questioned by the Southeast Asia disputed parties like the Philippines and some external countries like the United States. It is concluded that it is the result of China's discourse weakness in the public o- pinion and the discourse system of international maritime order specially. However, it doesn' t mean that the Line is fragile in the view of international Law. Hence China must seek her discourse power and advantage in the process of improvement of maritime mechanism and the rebuilding of international maritime order and it may create a favora- ble situation for the Line's international communication to get more international recognition.
