摘要
《真理抑或谬论:〈比较法总论〉之批判——兼谈我国比较法学的发展路径》一文对《比较法总论》提出的三点批判意见存在可商榷之处。《比较法总论》所提到的比较法之为超国家法律统一做的规划功能准备揭示和反应了21世纪共同法发展趋势,并非理想化;对于比较法的概念与性质,《比较法总论》通过对比较法研究对象、研究方法的介绍,勾勒出了一个较为清晰的比较法概念,并且明确了比较法既是一门学科又是一种研究方法的性质;在对比较法边界和法圈的划分上也不是想象和设置理论圈套,而是基于理性和缜密的分析,按照各个法律秩序和这些法律秩序所构成的整个群体所具有的样式进行分类,绝非法学者的意气用事和好事者的无聊之举。
The author presents three criticisms to Pandect of Comparative Lawin the paper A Truth Or a Fallacy：Critique of Pandect of Comparative Law — And on the Development Path of Comparative Lawin China,but they should be rediscussed here.Firstly,the viewpoint mentioned in Pandect of Comparative Lawthat the comparative law prepares the way for supra-state unification of law reflects the development tendency of Common Law in 21 st century rather than an idealization.Secondly,the Pandect of Comparative Law gives us a clear concept of comparative law through the introduction of research object and method,and states that comparative law is not only a discipline but a research method in nature;Thirdly,as to confirming the legal boundary and sphere of comparative law,it is a rational analysis rather than a fantasy or a trap of theory.And classifying them by every legal order and types of all legal orders is absolutely not a legal scholar＇s impulsive and snoop deed.
