On the Dilemma and Development of the Institutional Participation of Non-governmental Organizations in the International Environmental Compliance Mechanism

非政府组织制度性参与国际环境公约的监督执行是国际环境遵约机制发展的必然结果。尽管当前国际环境遵约机制为非政府组织的参与作了很多制度安排,但从实践效果来看,这些制度安排表现出滞后性和限制性的困境,引发了非政府组织参与实践功能和制度保证之间的矛盾。从根本上说,主权国家的意志才是提高非政府组织参与国际环境遵约机制制度化程度的决定因素。

Non-governmental Organizations＇ institutional participation in the supervision of the implementation of international environmental conventions is the inevitable result of the development of the international environmental compliance mechanism. Although there are many institutional arrangements for the Non-governmental Organizations in the implementation of international environmental conventions,those institutional arrangements are hysteretic and restrictive from the perspective of practice effect,which result in the dilemma between the practice and institutional arrangements. Basically,the will of the sovereign countries is the real deceive factor to improve the degree of institutional participation of Non-governmental Organizations in the international environmental compliance mechanism.
