摘要
由于市场变化的多样性和复杂性,用人单位与劳动者之间的劳动关系之债会发生概括转移,即由新用人单位承继原用人单位的法律地位。该概括移转不得损害劳动者的合法权益,用人单位需要履行保护劳动者的程序,如:通知劳动者并经劳动者同意,劳动者享有知情权、磋商权、异议权、解除权等各项权利。劳动关系之债依法概括移转后,劳动者可向承继劳动关系之债的新用人单位主张权利。劳动关系之债的概括移转与用人单位合并分立属于不同的法律概念,用人单位合并分立往往会导致劳动关系之债的概括移转。
Du to the complexity and variety of market, the debt of Labor Relations between employer and employee sometimes could be generally transfer, which means the fresh employer replace the original one. Obviously the generally transfer, which can not damage the rights of employee, demand the employer who perform several procures that include inform and consult. And the employee who have many rights such as information, consultation, rejection, rescission, may argue right against the new employer. Finally the general transfer of labor relations distinguish it from the annex and division of employer.
