同性恋群体作为特殊的社会群体,其人权保障问题近年来受到了愈发广泛的关注。在以更包容的态度对待同性恋群体、保障其享有同一般自然人无异的普遍人权的同时,突出对其性权利、平等权以及追求幸福的权利的保障,并以宪法为依托,通过进一步立法、建立同性恋者保护组织、建立违宪审查制度等途径实现对同性恋群体人权的有力保障。

As a special social group, the homosexual and their human rights has received increasing wide attention these years. While treating the homosexual with more tolerant attitude and ensuring they would enjoy common human rights compared with general humanity, it is more important to highlight the protection of their rights of sex, rights of equity and rights of pursuing happiness. Moreo- ver, on the basis of the constitution and according to further legislation, it is possible to provide the homosexual with stable protection by establishing homosexual campaign organization and judicial review system.
