国际化视野下惩治民用航空领域犯罪刑事政策之考察

新社会防卫理论是国际刑事政策的理论基础,该理论在联合国预防犯罪和刑事司法大会的会议文件都有充分体现。新社会防卫论国际化刑事政策与"国际航空安保公约"之间的密切联系,国际航空安保公约深受新社会防卫论国际化刑事政策的影响。国际化视野下民用航空领域犯罪的刑事政策应具有国际性、建构性、时代性、安全性以及经济性。现阶段,我国惩治民用航空领域犯罪刑事政策呈现四大基本现状:入罪化、罪名衔接不协调、"严打"政策、财产刑适用范围狭窄。
