论国家软实力对我国参与国际司法的影响

On National Soft Power's Influence upon Our Participation into International Judiciary

我国历来不愿意接受国际司法管辖权的立场凸显了我国参与国际司法的现实困境,而这种状况与我国软实力不足的现状直接相关。国家软实力经常通过对国际法律规范的形成,对国际司法裁判者文化观、价值观的作用来间接地影响国际司法。我国由于传统文化的内敛性、意识形态的独特性、外交政策的延续性等方面的因素,导致国家软实力水平与国家硬实力相比明显不足,在这一情势下我国显然无法对国际司法以及国际司法裁判者产生重大影响。因此,目前我国拒绝参与国际司法的态度应该是避免不可预知后果的当然选择,以防止对我国国家利益造成损害。从长远来看,我国很难完全回避国际司法,因此,需要适时调整思路、采取措施提升国家软实力,以增强我国在国际司法中的参与度和影响力。

International jurisdiction has long been unaccepted in our country, which shows the dilemma we met while participating in international justice and it indicates our inadequate soft power. The soft power of the country affects indirectly international judiciary through the formation of international law norm, influencing in- ternational judicial judge＇ s concepts of culture and value. Due to the convergence of traditional culture, the u- niqueness of ideology and the expansion of diplomatic policies, etc., our soft power is obviously less than hard one, and in such situations, we fails to take great influence upon international judiciary and international jud- ges. Therefore, currently China＇ s refusal to participate in international judiciary is intended to avoid some un- predictable consequences and to prevent our national interests from damages. In the long run, we cannot evade international judiciary completely, so we should adjust our thinking timely, adopt measures to improve the soft power of our country in order to enhance our participation and influence in international judiciary.
