摘要
《劳动合同法》及其配套法律法规中大量规定了企业给付劳动者金钱补偿/赔偿的情形,给付经济补偿金的情形最多。经济补偿金兼有违约补偿、失业保障、企业关怀、赔偿与惩罚等功能。经济补偿金的赔偿与惩罚功能不可取。设计经济补偿金制度时既要兼顾上述功能的轻重取舍,又要考虑到我国合同部门法以及相关部门法的原则、规定和制度体系。
"Labor Contract Law" and its supporting laws and regulations prescribe a lot of cases in which enterprises should make compensation or pay damages, and most of the time the compensations are economic compensation. The economic compensation has the function of default compensation, unemployment benefits, enterprise caring, compensation and punishment. But the compen- sation function and punishment function are not desirable. When designing the economic compensation, we should take the tradeoff of the functions above, the contract law and the principle, regulation and system of the related department law into account.
