摘要
内部责任体系是加拿大职业安全卫生法制中的重要制度,其构建了层级分明、责任明确的安全生产确保体系,并且有正当注意原则等法律规则及工会等配套制度的支持。与之比较,我国安全生产法制存在安全与生产结合不够密切;事故处理的司法因素弱;政府的角色定位传统等未来待改进之处。
Internal Responsibility System is very important to Canadian Occupational Health and Safety. It allocates authority and responsibility for OHS to every people of every level in one organization. Due diligence legal principle and collective action of Union provide important supports. Compared with IRS, the integration of work and safety in Chinese work safety legal system is not well e- nough ; the process of accident management lacks judicial involvement; the role of government is too aggressive.
