论区域府际合作治理与区域行政法

On the Governance of Regional Intergovernmental Cooperation and Regional Administrative Law

市场化和地方分权改革带来的公共行政区域化拓展、社会治理的转型、民主法治建设的进步促进了区域府际合作治理的产生。而区域府际合作治理的法治化要求则推动着以区域治理关系为调整对象的区域行政法的产生与发展。区域行政法不仅要遵循行政法基本原则,还要遵循区域非主权原则、区域多元平等原则、区域利益均衡原则等区域行政法的特有原则。区域行政法框架体系应当包括三个部分:围绕行政机关地域管辖限制与跨域治理客观需求的有效平衡,社会组织法律授权和共同体成员自治规则授权的有机统一构建的区域行政主体制度;政府负责下多元治理主体之间以信任为基础交织互动,共同承担公共责任的区域行政行为制度;以及以区域行政监督和多元化区域行政救济为核心的区域行政监督救济制度。

The reform of marketization and decentralization bring the prolongation of public ad- ministrative region, the improvement of democracy and legislation. The transition of social govern- ance leads to the governance of regional intergovernmental cooperation. Besides, the legalization on the governance of regional intergovernmental cooperation push the produce and development about regional administrative law which makes the regional governance relationship as its regulative object. The regional administrative law not only abides by basic principles of administrative law, but also re- gional non-sovereignty principles. The system of regional administrative law concludes 3 parts： the system of regional administrative, which is the effective balance between the territorial jurisdiction limitation for the administration and the objective demand for the cross-domain and the authorization that comes from social organization and autonomy of community members; the system of regional ad- ministrative action, which is the trust interaction among multiple governmental subject in charge of governments; the relief system of regional administrative intendance that makes regional administra- tive intendance and multiple regional administrative relief as its center.
