摘要
[目的/意义]随着复杂产品越来越普及,存在互补关系的专利呈现分散状态,并将阻碍创新,增加交易成本,限制竞争,降低社会福利。因此验证我国半导体照明产业专利是否呈现"专利分散"状态及对产业政策的影响有助于产业发展。[方法/过程]以分散度指数、首位度法则和分形维数为基础,构建测量"专利分散"的分析框架,并对我国半导体照明产业专利及其权利人分布状态进行分析。[结果/结论]研究表明:我国半导体照明产业开始呈现"专利分散"趋势,即在专利数量激增的情况下,专利权由越来越多的权利人享有。为了避免"专利分散"阻碍创新,解释了"专利分散"对我国的政策含义,并提出应对"专利分散"的政策建议。
[Purpuse/Sigulfieance] As the complex products are more and more popular,the complementary patents present fragmenta- tion, which hinders innovation,increases transaction costs,limits competition and reduces social welfare. So verifying whether "patent frag- mentation" exists in Chinese LED industry patents and has impact on LED industrial policy actively provides support for developing LED industry. [ Method/Process] This paper conducts analysis framework of measuring "patent fragmentation" based on the methods of dis- persal index, the first law and fractal dimension, and analyzes the patents distribution of Chinese LED industry. [ Result/Conclusion] The results show that Chinese LED industry patents have the tendency of "patent fragmentation". That is, the patents are owned by more and more patent holders, while the number of patents is soaring. To avoid hindering innovation, this paper explains the policy implication referring to the phenomenon of patent fragmentation, and puts forward some policy suggestions.
