摘要
新修的《食品安全法》确立了我国史上最严厉的惩罚性赔偿制度。惩罚性赔偿制度作为一种特殊的惩罚手段,历来饱受争议。文章通过梳理惩罚性赔偿制度的立法理念及其历史演进,剖析食品安全惩罚性赔偿制度的几个争议焦点,提出在实践中惩罚性赔偿制度应当适用的原则与方式,发挥其惩罚与威慑的功能。
The new ＂Food Safety Law＂ is the severest punitive compensation system in Chinese history. Since it is a special punitive method it has been controversial. By studying the idea of legislation and its historical evolvement, the controversial points are analyzed. Appropriate principles and methods are proposed to play the function of punishment and deterrence.
