Study on Difficulties and Countermeasures in Investigation of Criminal Cases Concerning Environment Pollution

环境污染问题已引起社会广泛关注,打击环境污染犯罪刻不容缓。目前,公安机关侦办环境污染案件普遍存在立案难、取证难、鉴定难和因果关系认定难的问题。多措并举,广泛收集案件线索以解决立案难问题;提高取证能力,规范取证以解决取证难问题;将环境污染司法鉴定纳入国家司法鉴定体系,统一鉴定标准和收费标准以解决鉴定难问题;采用疫学因果关系理论并辅之量多质高证据以解决因果关系认定难问题。

The environment pollution has been widely focused and the fight against the crime of environment is of great urgency. Currently, the difficulties of case filing, evidence obtaining, judicial appraisal, and identification can be seen ever- ywhere in the environment pollution criminal cases investigated by the police. Countermeasures should be taken, namely, we should widely collect case clues; improve the ability of evidence obtaining and standardize evidence obtaining; bring the environment judicial appraisal into the national judicial appraisal system by unifying the appraisal standard and unifying the collection of fees; and adopt the theory of the cause and effect relationship in the epidemiology in combination with enough high-quality evidences so as to solve the above mentioned difficulties that exist in environment pollution criminal cases.
