摘要
WTO裁决的有效执行,关涉WTO的权威和存续价值。随着中国在WTO被诉和败诉案件的增加,如何执行WTO裁决成为一个重要的现实问题。本文旨在对WTO争端解决中国败诉案执行相关的法律问题进行研究,通过分析中国败诉的原因、败诉案执行对中国的影响以及中国败诉案执行面临的现实困境,进而对中国败诉案执行提出完善建议。
Over the past 20 years, most of the rulings made by DSB have been effectively implemented. As cases in which China was sued or failed are increasing, how to implement WTO rulings has become a realistic question for China. This article aims at the study of relevant legal issues in the implementation of WTO rulings against China. It analyzes the reasons why China lost cases in the WTO, as well as the influence of implementation of WTO rulings for China, pointing out the dilemmas China faces. Based on the above analysis, it makes some suggestions for China in the future implementation practice.
