摘要
高校就业协议对毕业生的就业过程中起着承上启下的作用。在实践中,在用人单位与毕业生之间存在一些焦点问题,例如,用人单位是否有权在就业协议签订后禁止学生继续去其他单位应聘;在实习过程中的患病和负伤是否属于"工伤"等,明确就业协议的法律属性以及在此过渡时期用人单位与毕业生之间的法律关系,对于认定用人单位与毕业生之间是否存在劳动关系,解决争议问题具有积极的指导意义。
College employment agreement serves as a link for graduates' employment. In fact,there are some hot issues between employers and graduates,for example,whether the employers have the rights to forbid students to continue to apply for other enterprises after signing the employment agreement,whether the sickness and injury in the process of internship belong to industrial injury,and so on. Defining the legal attribute of employment agreement and legal relations between employers and graduates during the transition period have positive guiding significance,it will help determine the the existence of labor relation between employers and graduates and solve the controversial problems.
