我国金融行为监管体系的构建与发展研究:国际经验与借鉴

Research on the Construction and Development of the Behavioral Supervision System in China: International Experience and Reference

全球金融危机以来,国际上普遍认为以金融消费者权益保护为核心的行为监管缺失是危机爆发的根源之一。加强金融行为监管已成为国际金融监管共识与改革导向。以行为监管理论内涵分析为切入点,论述了行为监管与审慎监管的辩证关系;并通过比较分析,总结借鉴了国际上行为监管体系改革与发展的实践经验。在此基础上,探索构建了我国行为监管体系总体框架,对总体框架中金融监管法律体系、行为监管机构体系、标准体系、工具体系、行为监管信息平台五大体系的建设与发展进行了深入阐述,以期为当前深化我国金融监管体制改革提供模式选择与政策建议。

Since the global financial crisis, it has been generally believed that the failure of behavioral supervision which focuses on consumer financial protection is one of the roots of crisis. To strengthen the behavioral supervision has become the consensus and reform orientation of international financial supervision. Based on the theoretical analysis of behavioral supervision, this paper discusses the dialectical relationship between behavioral supervision and prudential supervision, therefore through the comparative analysis, summarizing the practical experience of the reform and development of behavioral supervision system in the world. Hence, this paper probes and constructs the overall framework of behavioral supervision system in China, and thoroughly describes the construction and development of legal system of financial supervision, institutional system of behavioral supervision, standard system of behavioral supervision, tool system of behavioral supervision and information platform of behavioral supervision, so as to provide mode selection and policy recommendations for deepening the reform of financial supervision system in China.
