Study on the Legal System of Administrative Mediation in Japan

随着现代社会发展,传统以公平优先、效率次之的司法纠纷解决机制愈发呈现出疲于应付的态势,准此,就需要建立一种兼顾公平与效率的"准司法"纠纷解决机制。相较于我国的行政调解制度而言,日本的行政调解取得了令人瞩目的成就,通过借鉴日本经验,逐步推动我国行政调解制度的完善。

With the developmen mechanism increasingly showing t of modern society, traditional priority to equity, efficiency of judicial dispute solve a struggling to cope with the trend, therefore need to establish a both fairness and efficiency of the quasi judicial dispute settlement mechanism. Phase compared to China＇s administrative mediation system, administrative mediation in Japan made remarkable achievements, by drawing lessons from the Japanese experience, and gradually promote the perfection of the administrative mediation system in our country.
