互联网环境下国际私法面临的挑战

The Challenge of International Private Law under the Internet Environment

国际私法主要是指解决涉外因素的民法或商法,对解决法律冲突,调节国际关系具有重大现实意义。然而随着互联网的扩散和广泛应用,涉外法律案件变得极为复杂,传统的国际私法在理论和实践上都存在着不足。本文从冲突法、实体法和法律程序三方面着手,分析了互联网环境下国际私法所面临的挑战,并提出了相关解决对策。

International private law mainly refers to international law to resolve foreign elements of civil or commercial law,to solve the conflict of laws. Regulating international relations is of great practical significance. However,with the proliferation of the Internet and the widespread application of foreign law has become extremely complex case. The traditional private international law in theory and practice there is a shortage. From the conflict of laws,substantive law and legal processes three aspects,we analyze the challenges in the Internet environment facing private international law,and put forward relevant countermeasures.
