民生法治:十八大以来农村社区治理创新的法治保障研究

People's Livelihood by Law: Study on Legal Guarantee of Innovation of the Rural Community Governance since The Eighteenth National Congress of the CPC

十八大以来,我国农村社区法治建设的基本经验与发展趋势表现为:农村社区法律体系初具规模、农村基层民主政治建设法治化进程有序推进、农村社区公共法律服务体系日趋优化、多元主体有序参与农村社区法治建设、农村社区公共安全体系逐渐完善。可以看出,我国农村社区在法治建设的实践领域已经取得了显著成就,然而如何在理论与认识上对农村社区法治建设的实践经验进行凝炼和提升才刚刚开始。从我国农村社区法治建设目前所取得的成效来看,法治的实践性有效回应了农村社区建设中的民生难题;同时,在改善和保障民生中,法治突显出其特有的优势功能。民生法治的双重意蕴,要求我国农村社区建设必须建构起相应的农村社区民生法治体系:培养社区规则意识,在改善民生中落实社区协商制度化;推进社区赋权转能,在重心下移中厘清治理主体职责;统筹城乡治理环境,在多元共建中共享社区良性互动。

Ever since The Eighteenth National Congress of the CPC, the basic experience and development trend of the rule of law in our rural community are as follows： rural community legal system took shape; grassroots democracy in rural legalization process is in an orderly way; rural community public legal service system is being optimized; multiple subjects involved in building the rule of law in rural communities are ordered; rural community public safety system gradually improved. As can be seen, China＇s rural communities in the field of the rule of law practice has made remarkable achievements, but how to upgrade and concise the theory and understanding of the practical experience of the rule of law in rural communities is just begun. From the perspective of the effectiveness of the construction of the rule of law in the rural areas of china, the practice of rule of law has effectively responded to the people＇s livelihood problems in the construction of rural communities; at the same time, the rule of law highlights its unique advantages in improving and ensuring people＇s livelihood. The dual implication of People＇s Livelihood by law requires that the construction of the rural community must construct the appropriate legal livelihood systems of rural communities： cultivating the sense of community rules; improving people＇s livelihood in implementing community consultation institution; promoting community empowerment and clarifying the main responsibilities of governance in the lower center of gravity; coordinating urban and rural governance environment, sharing community positive interaction in the multi build.
