文中从天津港"8·12"事故调查报告评判监管缺位的依据出发,从现实和法理角度深入分析了海事行政执法依据的基本框架,并以油船监管为例分析了海事行政执法依据的梳理路径,最后明确了海事行政执法依据的基本框架和梳理的具体操作路径。

In view of the basis for determining the inadequacy of supervision and control in the investigation report for ＂8 · 12＂ accident at Tianjin port, the paper analyzes the basic framework for the legal basis of maritime administrative law enforcement from the perspectives of both practice and legal theories. It also studies the approaches for organizing such legal basis taking the control ofoil tankers as an example. Based on the above analysis, it sets up the basic framework of the legal basis for maritime law enforcement and the specific approaches for organizing the legal basis.
