论安全例外的不确定性对WTO稳定性的影响被引量：1

摘要 GATT安全例外从裁决权到裁判标准都处于不确定的状态。其不确定性在个案中可能造成成员国对安全例外范围的扩张性解读,以及出于安全利益外的其它考虑援引安全例外。但安全例外的不确定性对WTO的稳定性有重要意义。在WTO体制下前述消极影响受到国家声誉及非违约之诉的限制,并且不确定性使得成员国倾向于通过外交谈判解决争议,客观上避免由WTO承担裁决政治问题的风险,对于WTO的稳定性有积极作用。
