视频聚合平台运行模式在著作权法规制下的司法认定

随着移动智能设备的普及,视频聚合平台发展迅猛。视频聚合平台采用所谓的深度链接技术直接向用户提供视频资源。具体来说,根据其行为手段及所采取的技术手段的不同,视频聚合平台又分为采用一般深度链接手段的聚合平台及采用盗链手段的聚合平台。其中,采用盗链手段的视频聚合平台违背被盗链的视频网站的意志,通过技术破解措施,直接盗链视频网站的资源,达到向用户提供作品的目的。上述盗链行为,应在著作权法上认定为信息网络传播权的直接侵权行为。

With the popularization of mobile smart devices, video aggregation platforms witnesses fast development. Video aggregation platform uses deep-link technology to provide its users with video resources. To be specifi c, video aggregation platform mainly uses two kinds of technologies： deep-link and hotlink. Those using hotlink technology provide its users with video resources obtained through bypassing technical measures, which violates the will of other video websites. The behavior of hotlink should be regarded as direct infringement of the right of communication through information network.
