摘要
诚实信用原则作为现代民法的最高指导原则和统摄私法领域的帝王条款,其在《商标法》中的立法确认既符合诚实信用原则的扩张趋势,亦是商标注册制度在商标权保护层面的完善和有效补充。诚实信用原则的高度抽象概括与司法实践运用的具体明确之间的矛盾表明,于商标争议的处理而言,对《商标法》中的诚实信用原则进行具象化阐释,使其成为具备可操作性的法律规范,意义尤为重大且现实需求迫切。
The principle of good faith is known as the highest guiding principle of modern civil law and the king clause in the fi eld of private law. Its legislative confi rmation in the Trademark Law not only conforms to the expansion trend of the principle of good faith, but also is a perfection and effective complement of trademark registration system in the protection of trademark rights. As the principle of good faith is highly abstract, which may cause problems in judicial application, therefore, it is urgent and imperative to give effective interpretation to this principle, so that it can be used as a clear-cut legal norm.
