摘要
教师申诉是教师的一项权利,在一起教师申诉案中,法的溯及力问题成为是否受理的核心。法不溯及既往原则在适用中存在一些例外情况,如某些程序性规定具有溯及力,但必须严格限制其适用范围。《教师法》39条进一步对教师申诉制度进行了规定,主要是对教师申诉权的实体规定,不应将其视为程序性规定,且《教师法》未明确规定该法具有溯及力。
Teacher appeal is teacher's right. Law retroactivity is the core element to consider when deciding wheth- er or not to accept a teacher appeal case. In the application of the principle of non-retroactivity of law, there are some exceptions. For example, certain procedural provisions have retroactive effect, therefore, the scope of their application must be strictly limited. "Teachers Law" 39, the further provisions on teacher's appealing system, are mainly substantive provisions of teachers" right to appeal. It should not be regarded as procedural provisions. More- over, Teachers Law does not expressly state that the law have retroactive effect.
