危险驾驶罪的强制措施研析

Research on the Compulsory Measures Applied to Dangerous Driving Cases

危险驾驶罪是刑法所有罪名中唯一一个最高刑为拘役的罪名,也是刑法所有罪名中唯一一个不能适用逮捕这一强制措施的罪名。因此,危险驾驶罪的强制措施适用方式成为一个亟待解决的问题。《刑法修正案(九)》出台后,危险驾驶罪的行为类型增加至四种,即醉酒驾驶、飙车驾驶、超员超速驾驶以及违规运输危化物品驾驶。鉴于醉酒驾驶与其他三种行为在行为方式、入罪标准和人身约束紧急性上存在不同,其危险驾驶罪的强制措施适用应当采用严格的"二分法"。

Dangerous driving is the only crime whose maximum penalty is detention and the only crime whicharrest cant apply to. Therefore, it has become a tough problem on how to make compulsory measures available indangerous driving cases. After the ninth amendment to criminal law has enacted, the behavior types of dangerousdriving are increased to four： drunken driving, drag racing, overcrowding/speeding and illegal hazardous chemicaltransporting. Since drunken driving differs from the other three kinds of behaviors in the way of act, incriminatestandard, necessity of custody, compulsory measures taken in dangerous driving cases should strictly adopt the ＂dichotomy＂.
