Difference between Titles and Functions: the Interaction between Compilation of the Law and Administration in the Song Dynasty

唐宋时期法典编纂从律令格式到敕令格式的转变,学界的探讨,多就法典体系内部的法律形式,及其变迁问题,忽略了法典编纂产生的背景。因此,将法典编纂同王朝政治体制与政务运行机制联系起来,尝试把握法典体系与政治体制、政务运行机制的关系,有助于探究唐宋变革背景下的宋代法典编纂变迁问题。

The legal system of the Tang dynasty represents the peak of acient chinese law compilation and ideas. The form of the law and its development were requently discussed before, the background and situations of the law compilation are often neglected. Thus, the dissertation attempts to eonsentrate the connection between the compilation and the administration and its functioning. To be further, the thesis will reveal the whole process of the conversion of legal system in the dynastie transformation in the Song Dynasty.
