摘要
碳排放权交易制度以健全有效的碳排放监管法律制度为基础。政府依法对参加碳排放权交易的排放单位进行排放准入监管时可考虑两种进路:一是碳排放监测计划备案制,一是碳排放许可制度。碳排放监测计划备案制虽在操作中具有易行性、灵活性,但在法律上具有不少争议和弊端。结合我国环境保护、经济发展和政府监管等现实情况,我国可依法设立碳排放许可制度,并可结合碳排放权的发展权属性对不同排放单位进行合理的区别对待。
Abstract : A sound and effective legal system regulating the carbon emissions activities is the cornerstone of carbon emis- sions trading. As far as the governmental regulation of the access to the emissions activities by the emitters covered by the car- bon emissions trading is concerned, two options can be considered: one is registering system for the record,the other is carbon emissions permitting system. Although the registering system for record is feasible and flexible in practice, it is not free of con- troversy and disadvantages from the legal perspective. Taking account of China' s specific circumstances in terms of environ- mental protection, economic development and governmental regulation, China can establish the carbon emissions permitting system according to its own legal system. Moreover, a differential treatment between different emitters can be applied based on objective justification, in view of the special feature of carbon emissions right as the right to development.
