政治制度和法律学说与人性紧密相联,对人性的不同理解和判断,所建构的政治社会及其制度框架也存在极大的差异和不同。文章从分析性恶论和性善论两种人性观下的制度构建入手,演绎出人治制度类型和法治制度类型,对于由人治向法治转型的中国而言,以性恶论为逻辑基础的法治制度类型是未来中国必然的制度模式。

Political system and legal theory are closely linked with human nature. Dif- ferent understanding and judgment on human nature may develop various political society and system. From the perspective of good and evil nature theory, the man-ruling and law- ruling patterns are discussed. For China that is transiting from the former to the latter,the law-ruling is an inevitable system pattern.
