论我国现行房屋征收补偿制度的完善

The Improvement of China's Current Housing Levy Compensation System

随着我国城镇化的快速推进,房屋征收问题已经成为热点问题。从目前来看,房屋征收补偿制度的不完善不但成为隐藏腐败的灰色地带,而且也使政府和民众间的矛盾日益尖锐。以1991年颁布《城市拆迁管理条例》为起点,到我国2011年通过《国有土地上房屋征收和补偿条例》,我国也在不断努力去完善房屋征收制度。但无论从制度层面还是实践中,房屋征收制度仍存在很多问题。文章首先从研究征收行为出发,发现其中存在的问题并分析其产生原因进而给出合理性的建议,以期更好地保护公民的私有财产所有权,维护社会的公平正义。

With the rapid development of urbanization in China, the issue of housing levy has become a hot issue. At present, the imperfection of the housing levy compensation system not only becomes the gray area of hidden corruption, but also deepens the contradictions between government and the people. From 1991 the ＂Regulations on the Management of Urban Relocation＂ as a starting point, to 2011 the ＂State-owned Land on the Housing Levy and Compensation Ordinance＂, our country is constantly trying to improve the housing levy system.But there are a lot of problems in not only the system level but also the practice of housing levy system. The paper discusses the problems of the expropriation behavior and analyzes its reasons and gives suggestions to better protect the rights of citizens and safeguard social fairness and justice.
