当今时代已经进入到法定犯时代。法定犯时代的犯罪现象已不同于传统农业社会的犯罪现象,社会所面对的犯罪威胁主要来自于法定犯罪,而不再是传统的自然犯罪或街头犯罪。在强大的政府权力以及刑法等正式社会控制力量面前,传统自然犯罪或街头犯罪对社会已经难以构成实质性威胁和挑战。与之相反,随着社会关系的复杂化和社会经济活动的日益活跃,法定犯罪大量增多且类型越来越复杂多样,法定犯罪问题已经成为当今社会政治秩序、经济秩序以及生活秩序的主要威胁。法定犯时代的犯罪问题主要是法定犯罪问题,而法定犯罪问题本质上是一个公共政策问题,通过制定好的公共政策予以化解,是解决法定犯时代犯罪问题的最佳政治之道。

We are coming into the time of mala prohibita. Criminal phenomena in time of mala prohibita are different from those in traditional agricultural society. Criminal threats confronting the society are mainly legal crimes,not natural crimes or street crimes any more. Confronted by strong government power and formal social control power such as The Criminal Law,traditional natural crimes or street crimes are difficult to constitute a substantial threat and challenge. On the contrary,along with the development of complicated social relations and increasingly active social activity,legal crimes have increased in a large quantity and the types have become more and more diversified. Legal crimes have become the main threat endangering political,economic and life order in the current society. The crime problem in time of mala prohibita is mainly legal crime problem,the essence of which involves public policy issue. We shall formulate public policy,which is the best way to address the crime problem in time of mala prohibita.
