论国有经济的主导力量定位--《宪法》第7条的规范诠释

On the State-owned Economy's Status as Leading Force:A Normative Interpretation of Article 7 in the Constitution

1993年修宪后,基于中共中央对于国企境况的论断,国有经济主导力量定位的基本内涵持续发生了积极的变迁。在近年来国有经济显著发展的背景下,应将国有经济制度与社会保障制度衔接,通过上缴国有资本收益更多用于民生事业等措施,突出主导力量定位中促进民生改善的首重和首要内涵,落实全民所有的宗旨和避免"与民争利"问题;而结合另一重要内涵,整体上,主导力量定位与社会主义本质形成完整对应,能在对公有制的体现这一根本意义上实现变迁后的回归。

After the amending of the Constitution of PRC in 1993,according to the CPC Central Committee＇s views of the circumstances of the State-owned enterprises,the basic connotation that positioning stateowned economy as leading force has been consistently changed in an asymmetrical manner. Nowadays,due to the remarkable development of the state-owned economy in recent years,it is time to connect state economic system with social security system. Through the measures like increasingly appropriating the profits from stateowned enterprises to people＇s wellbeing,highlighting the priority connotation of the leading force positioning that promoting the improvement of people＇s wellbeing,reinforcing the whole people ownership and avoiding the problem of competing for benefits with people,in addition,combining with the connotation of the other part,as a whole,the leading force positioning will completely correspond to the socialism essence,there will be an essential return of the position—in the sense that as reflection of the public ownership—from the Constitutional Change.
