“互联网+”背景下的司法信息公开研究——以最高人民法院“司法公开示范法院”为对象

Research on Judicial Information Disclosure under the “Internet + ”Background:With the Supreme People's Court “Judicial Public Demonstration Courts” as the Objects

以最高人民法院《关于人民法院在互联网公布裁判文书的规定》(法释〔2013〕26号)的实施为标志,司法信息的网络公开成为"互联网+"时代的潮流。司法公开是宪法和法律规定的一项基本原则,是实现公民基本权利、增强司法公信力的重要举措。各地人民法院按照司法公开的六项内容和标准,采取网络平台、社交媒体等创新方式,以适应司法公开的现实需求。本文根据最高人民法院确定的100所示范法院(包括高级、中级、专门和基层人民法院)网络信息平台建设情况,分析比较了各地平台模式的差异,指出了目前存在的一些问题,如平台功能重叠、冲突,法院政务网站未实现全面覆盖;以及公开信息内容不够全面,尤其是行政类、执行类文书公开率远低于民事类、刑事类文书,动态信息之间缺乏有效整合等。为适应"互联网+"时代信息公开的需求,提高司法信息公开的质量,应进一步细化司法公开的操作规程,建立健全司法信息公开的申请和反馈机制,增强平台的整合性功能。

Justice information publicity becomes popular in ＂Internet ＋ ＂eras with the implementation of the ＂Regulation on the People＇s Court announcement of Judgment Documents on the Internet＂.（ No. 26[2013]interpretation） Judicial publicity is a fundamental principle prescribed by the Constitution and the law. It is the also an important measure to fulfill the basic civil rights and strengthen the judicial credibility. People＇s Courts of various levels publicize their judgment documents utilizing internet and other social media platforms in accordance with the six standards to meet the need of judicial publicity. According to internet-based platform construction of 100 model courts confirmed by the Supreme People＇s court（ including High Courts,Intermediate Courts,Courts of Special Jurisdiction and basic People＇s Courts）,this thesis does a comparative analysis of the difference among these platforms and points out some current problems,which includes platform function overlap,conflict,the inadequate coverage of courts affairs website; the insufficient contents of the publicized information,especially the administrative and enforcement documents are much fewer than the civil and criminal documents,and the lack of effective integration of dynamic publicized information. Therefore,in order to meet the needs of information publicity in ＂Internet ＋ ＂era and improve its quality,further efforts to refine operation procedure of judicial publicity should be made. What＇s more,information publicity mechanism on the application and feedback should be established and strengthened to improve platform＇s integrated function.
