摘要 现代社会中随着经济的不断发展,悬赏广告被应用于社会多个领域。但是我国现行法律对悬赏广告的规定却不够明确,难以处理一些疑难复杂的实践问题,并且引发法学界的长期争论,矛盾的中心所指就是悬赏广告法律性质。关于悬赏广告的法律性质,理论界主要存在"单独行为说"和"契约说"两种观点,此两种观点各有利弊,但"单独行为说"较之于"契约说"更具优势,一方面弥补了"契约说"的缺点,另一方面使法律关系明确化。通过对悬赏广告的概念和现行的规范作简要分析,吸收借鉴国内外法学界的研究成果,对这两种观点进行系统的比较,在支持"单独行为说"的基础上提出一些需要进一步解决的问题以及建议,从而兼顾各方利益,维护法律的公平正义。 With the development of economy in modern society, reward advertisement is used in many areas in society. However, the provisions of the existing law on reward advertisement are not clear enough, it is difficult to deal with some complex practical problems, so that leads to long -term argument among theorists, the center of conflicts refers to the legal nature of the reward advertisement. The argument over the characteristics of the reward - offering advertisements is still heated, owing to the existence of the contract theory and the individual behavior theory, these two perspectives have advantages and disadvantages, but the individual behavior theory is more reasonable. The individual behavior theory makes up for the shortcomings of the contract theory, on the other hand makes the legal relationship clarified. This paper aims to take into account the interests of all parties, and maintain fairness and justice of the law, according to the brief analysis of reward advertising concepts and existing norms, what' s more, draws on the experiences of achievements both here and abroad in theoretical realm, comparing these two viewpoints systematically, supporting the individual behavior theory on the basis of the need to make some further address and solve problems.
