新疆群体性事件应急处置法律机制研究

On Law Mechanism of Emergency Response to Mass Affairs in Xinjiang

新疆群体性事件应急"一案三制"建设卓有成效,但在应急预案的制定和应用、法律规定、应急处置、预警机制及评估善后等方面存在一些问题。为有效处置群体性事件,应加强应急预案的编制,细化预警标准,加强预案的演练和评估,完善相关法律法规,赋予公安机关在紧急状态下的决策权,对处置权力进行更为具体的规范设定,建立和完善应急处置权力的司法审查和各类监督,为各种应急主体参与机制提供法律保障;重视公安部门的装备配置和自我防护,将自我防护训练和实战训练的考核成绩纳入综合素质考核评价体系之中。

The construction of＆quot;One Case Three Systems＆quot;in mass affairs emergency system in Xinjiang is fruitful, but the establishment and application of emergency, law rules, emergency response treatment and early-warning mechanism and valuation of preparing the case and rehabilitate waiting still have some problems. To effectively treat mass affairs, we should strengthen the emergency preparation plan, early warning standard, and improve the rehearsal and evaluation. It is necessary to make perfect related laws to protect the right under the emergency state, to lay emphasis on the equipment and self-protection of police, to take the achievement of protection training and practical training into the comprehensive assessment system.
