摘要
当前,我国第三方网上支付存在消费者个人信息被泄露、第三方支付机构存在错误支付和资金监管不到位等问题。我国可借鉴美国、欧盟法律规定的相关经验,通过加强消费者个人信息的保护、完善第三方支付机构的支付制度、加强第三方支付机构的资金监管以及完善电子商务和电子支付市场的法律规范等措施来保护消费者合法权益。
At present, problems in the third party online payment include: the consumer personal information leaking, third - party payment errors and the third party capital regulation. Our country can draw lessons from the experience of the United States, the Euro- pean Union law. We can strengthen the protection of consumers' personal information, improve the third - party payment mechanism, strengthen the regnlatory capital of third - party payment institutions and perfect the legal norms of electronic commerce and electronic payment market.
