回族农村妇女继承权问题的考察——以平罗县宝丰镇为例

An Investigation of Hui Women's Right of Inheritance in Rural Areas——Taking Baofeng Town in Pingluo County as an Example

本文通过对宁夏平罗县一个回族聚居镇的田野考察,展示了当代回族农村妇女继承权落实存在的诸多问题,具体表现在回族农村妇女丧偶继承权难以实现,回族农村出嫁女子的土地承包经营权与继承权被事实上剥夺,回族农村妇女"主动"放弃继承权的现象普遍存在等方面。要改变这种状况,须从提高回族农村妇女的受教育程度入手、加强对国家继承法的宣传,清理违反《继承法》的村规民约,注重发挥伊斯兰教宗教人士的正面引导作用,通过以上合力作用,推动回族农村妇女继承权的落实,实现社会和谐。

Through a field investigation of an inhabitation town of Hui in Ningxia Pingluo county, this article explores some problems in the implementation of Hui Women＇ s right of inheritance in contemporary Chinese rural areas, which are embodied in the following aspects ： widowed Hui women＇ s right of inheritance is hard to implemen- ted in rural areas; contractual right of land and right of inheritance of married Hui women are deprived in reality; the phenomenon that Hui women ＂voluntarily＂ give up their right of inheritance is commonly seen in rural areas, etc. The thesis suggests that the following measures can be taken together to form a composite force to improve the situation, to push forward the actual implementation of rural women＇ s right of inheritance in rural areas and to real- ize social harmony ： Firstly, the education level of Hui women in rural areas must be improved ; Secondly, the pub- licity of inheritance law must be strengthened; Thirdly, village regulations that violate inheritance law must be cleared up; Fourthly, positive and leading roles of Islamic religious public figures could be exerted.
