我国诉讼财产保全责任险的产生环境与发展建议

在法律诉讼中,经常会有涉及财产保全的问题,根据法律规定,财产保全要求诉讼申请人支付与保全财产价值相当的担保,这样的规定往往给诉讼申请人带来极大的经济压力,影响其合法权益的维护。为解决这一问题,诉讼财产保全责任险在我国产生并逐渐试点推广。本文对诉讼财产保全责任险在我国产生的环境和背景展开分析,并结合国外经验对该创新险种的未来发展提出几点建议。

In legal proceedings, there often involves the problem of preservation of properties. According to the laws, the litigation applicant is required to provide warrant equivalent to the value of the preservation property, which imposes great economic pressure on the applicant and influences their legal rights. To resolve this problem, litigation property preservation liability insurance is introduced into China and get spread as a pilot scheme. This paper makes an analysis on the environment and background of litigation property preservation liability insurance, and puts forward some suggestions on the future development and innovation of the insurance with reference to the experience of foreign countries.
