以“人肉搜索”为视角对我国个人信息权保护的反思

Reflection upon the Protection of Personal Information Right in China from the Perspective of "Human Flesh Search"

十八届三中全会审议通过了《中共中央关于全面深化改革若干重大问题的决定》,将网络治理提升到空前的高度。随着科学技术的进步,尤其是数字技术和信息技术的迅猛发展和广泛运用,"人肉搜索"这一网络现象突出。其一方面发挥着舆论监督的作用,同时也使得个人信息权的保护面临着前所未有的严峻挑战。因此,本文从界定"人肉搜索"的法律性质入手,深入探讨与其密切相关的个人信息权受到的冲击,寻找其中存在的法律规制漏洞,并通过对比全球治理环境下个人信息权监管及保护的相关措施,最终落脚于个人信息权保护的法律治理路径。随着我国"一带一路"进程的推进,网络信息的区域性和全球性交流增多,我国迫切需要加大对个人信息权的保护力度,做到在信息时代的全球化浪潮中掌握主动权。

The third plenary session of the eighteenth Central Committee of the Communist Party of China reviewed and passed ＂The Decision of the Central Committee of the Communist Party of China about Deepening the Reform of Certain Major Issues＂, which has upgraded the governance of the network to an unprec-edented height. With the progress of science and technology, especially the wide use of digital and information technology, ＂human flesh search＂ becomes an outstanding network problem. It plays the function of monitoring public opinion, but at the same time it also poses unprecedented challenges to the protection of personal information right. Starting from the legal definition of ＂human flesh search＂, this paper presents an in-depth discussion about the challenges comprised by ＂human flesh search＂ to personal information right, whereupon existing loopholes of legal regulation are examined. After comparing worldwide monitoring and protection measures for the protection of personal information right in the environment of global governance, this paper ends up with suggestions for the protection of personal information right through legal governance. The advancement of ＂One Belt and One Road＂ helps increase the communication between the regional and global network information; thus it is urgent to strengthen the protection of personal information right so that initiatives will be taken in the era of information globalization.
