《反恐怖主义法》中帮教、矫正制度的落实路径——解读《反恐怖主义法》第二十九条

The Implementation of Education and Correction System in Anti-Terrorism Law——on Anti-Terrorism Law article 29

2016年1月1日《中华人民共和国反恐怖主义法》(下文简称《反恐怖主义法》)颁布并施行。该法共十章、九十七条,就我国反恐工作的原则、调查、处置、保障等各方面进行了全面的规定,其中第三章安全防范的第二十九条对恐怖活动中的胁从犯和尚不构成恐怖犯罪的轻微犯做出了帮教的规定,对服刑的恐怖分子进行矫正的要求。2016年3月22日的比利时机场恐怖爆炸案,对全世界的反恐工作又一次发起了挑战。面对日益严峻的反恐形势,如何有效地对胁从犯、轻微犯进行帮教?如何对恐怖分子进行矫正教育?这些问题必须重视起来。借鉴国外的先进理念,结合我国的社会现状,可提出以下途径:明确落实主体,推广帮教、矫正一体化;丰富落实方式,推进帮教、矫正高效性;加强落实监督,推动帮教、矫正持续性。

Thc anti-terrorism law of China （hereinafter referred to as the anti-terrorism law） with 10 chapters and 97 articles, was promulgated and implemented on January 1, 2016. It makes comprehensive regulations about China’s counter-terrorism work, such as the principle, investigation, disposal and security, etc. Article 29 in the third chapter makes relevant provisions about the help and education to accomplices under duress and people who have committed minor offenses in terrorist activities. Terrorist bombing in Belgium airport on March 22, 2016 defied the global anti-terrorism work. How to effectively help and educate accomplices and people who have committed minor offenses and how to correct the terrorists in such an increasingly severe counter -terrorism situation？ These problems should be attached great importance. Drawing lessons from foreign advanced concepts, considering current social situation in China, this article suggests the following ways： defining the subjects clearly and promoting integrated help, education and correction pattern, diversifying implementation way and promoting education and correction efficiency, strengthening the supervision and promoting sustainability of education and correction.
