对集成电路布图设计专有权司法保护有关问题的思考

Reflections on Problems Concerning Judicial Protection of the Exclusive Right of Layout Design of Integrated Circuits

侵犯集成电路布图设计专有权案件是知识产权案件中最难审的一类案件,有许多基础性的问题有待研究清楚。以法院生效判决为研究素材,通过分析指出,只有具有独创性的布图设计才受到专有权的保护,法院判决在布图设计内容的确定、独创性的认定、布图设计侵权对比等方面,还存在着不同的判断标准与方法。根据布图设计的基本法律制度及原理,提出并论证解决上述争议问题的具体方法。

It is the thorniest task to trial the cases concerning infringement of layout design of integrated circuits among all IP-related cases. Many rudimentary problems still wait for further researches. The paper studies and malyzes a collection of relevmt effective judgments, pointing out that only original layout designs deserve exclusive protection. Different judgment standards and methods in determining layout design content, establishing originality, and making contrast to the infringing layout design exist in court judgments. The paper suggests and demonstrates a number of concrete methods in solving the above-mentioned problems, based on the basic legal system and principles of layout design.
