国际法视野下的著作权个人使用例外

Personal Use Exception of Copyright from the Perspective of International Law

从相关国际著作权条约入手,梳理限制例外条款,以确定国际条约下著作权个人使用例外的义务。我国著作权个人使用例外条款应当符合有关国际条约的义务。我国现行著作权法和修改草案中的相关规定尚有不足之处,因此有必要借鉴有关国家和地区的相关立法,完善我国著作权个人使用例外条款以及相关制度。

The paper sets out to study the provisions of limitations and exceptions in the international copyright treaties, to determine the obligations on the personal use exception of the contracting parties under the international treaties. The provisions relating to the personal use exception in China^ copyright law should fiilfill the obligations provided in the international treaties, which China has entered into. However, the provisions in the current copyright law and the pending drafts still have some insufl＆ciencies, so that it is necessary to learn from the concerning legislations in some other countries and regions to improve the provisions and systems relating to the personal use exception of copyright in China.
