我国行刑社会化的实证考察及其潜在风险研究——以行刑社会化的思想源流为切入

An Empirical Study of the Socialization of Execution in Our Country and Its Potential Risks——Starting from the Ideological Origins of the Socialization of Execution

行刑社会化思想发端于19世纪后半期的刑事近代学派,于社会防卫运动的兴起走向成熟。我国目前正处在重大的社会转型期,受政治、经济、文化等因素制约,过快推行行刑社会化会面临诸多风险。要克服这些风险,突破目前我国行刑社会化的困境,应当完善行刑社会化的相关配套制度,循序渐进地推进行刑社会化。

The socialization of execution criminal modern school originated in the late half of the nineteenth century became matured during the rise of the social defense movement. Our country is currently in a major social transition period; implementing the socialization of execution is dominated by political,economic,cultural and other factors,so it must be slowed down,or it will face many risks. To overcome these risks and to break through the dilemma of the socialization of execution in our country,the relevant supporting system of the socialization of execution should be perfected,and the socialization of execution should be implemented in an orderly way step by step.
