全面推进依法治国背景下《管子》法治思想研究

Guan zi Legal Thought Research under the Background of Promoting the Rule of the Country by Law

《管子》中蕴含的法治思想极其丰富,涉及到治国、治军、治民的法律和相关的赏罚机制以及民间社会生活秩序的尺度规范。具有代表性的法治思想有以法治国、立法合民心、执法必严、礼法并重等。在全面依法治国建设的大背景下,批判继承《管子》的法治思想,提出完善法律体系、有法必依、依法治国与以德治国相结合等措施。

Guan zi contains extremely rich legal thought, relates to the rule of law, army, the people rule, the reward mechanism and the scale standard of civil society life order. The representative legal thought includes rule by law, legislation to fit the people, enforcing the law strictly, paying equal attention to legislation and so on. In the context of promoting construction of the rule of law, it is necessary to criticize and inherit Guan zi legal thought. The paper proposes such measures as improving the legal system, observing the law, ruling the country by law and by virtue.
