以审判为中心视角下的侦查监督模式转型

The Transformation of Investigation Supervision Mode in the Trail-centered Perspective

以审判为中心的诉讼制度改革必然要求摒弃侦查中心主义、卷宗中心主义,重塑侦、捕、诉、审关系,对侦查监督工作提出了新要求。以侦查监督工作为视角,着重从不适应审判中心原则的问题进行分析,如审前羁押率居高不下,监督职能发挥不充分,审查逮捕亲历性,司法性不强,与审判机关衔接不畅等。从确立诉前主导地位,严把证据关,增强侦查监督工作亲历性,司法性等方面实现与审判为中心原则的契合,进而实现侦查监督工作的转型。

The trial-centered lawsuit system reform inevitably requires to abandon the investigation centrism and the file centralism. Remodeling the relation of investigation, arrest, prosecution and trial puts forward new requests for investigation supervision work. The author, in the perspective of investigation supervision work, focuses on analyzing issues unsuited to the trail-centered principles, such as the high pre-trial custody ratio, poorly playing the supervision function, the weakness of arrest examination experience and justice, the poor connection with the trail institution. The author tries to implement the agreement with the trail-centered prin- ciple from the aspects of establishing leading position in pre-litigation, strictly adopting evidence, enhancing the experience and justice of the investigation supervision work, in order to achieve the transformation of in- vestigation supervision mode.
