摘要
经营者散布真实信息损害竞争对手的商业信誉、商品声誉的,如真实事实是过时的,无关紧要的,不完整的,片面的或者有保留的,都可能对消费者构成误导,从而扭曲正常的竞争秩序,成立不正当竞争行为。本文参考德法等国司法实践,考察基于真实事实的诋毁商誉的具体情形,探讨了基于真实事实诋毁商誉构成不正当竞争的理论基础和判断标准。
Business operators who disperse truth information to hard business reputation, product reputation would violate unfair competition law if the information is outdated, irrelevant, incomplete, on-sided or preservative.This article examines the circumstances of truthful disparagement by referring to several cases in Germany, France and other jurisdictions, exploring the theoretical and practical criteria to determine unfair competition by disparagement based on truthful information.
