侦讯策略技巧论

Theory of Strategy and Skills of Investigation

侦讯策略技巧是智取口供的高超艺术,它并非没有对抗性。利用矛盾、使用证据、说服规劝,都有双方的博弈。侦讯的提问、应答等方式,都需策略性表达。侦讯需要谋划环境,造势攻心。如心理空间的递进、调整光线的范围和强度、给予东西缓解气氛等。而侦讯行为,则需渗入嫌疑人内心,穿越其意识,如规范肢体行为、握手以暗示、运用目光注视等。相应的心理技巧,还有联想反应、让嫌疑人复述、删词和填词、自由交谈等,用以窥探和掌控嫌疑人心理。在双方的意志对抗与情绪对决中,侦讯科技的经验性、侦讯策略的艺术性、口供的可采性,都存在着条件有限性问题,需侦查员灵活调整之。

The strategy and skill of investigationis a superb art which outwits confession,and also have antagonism.It is a game between investigator and suspect who use strategies of contradictions,showing evidences and persuading.It needs strategic expression in questioning and answering during investigation and interrogation.In addition,interrogation needs environment and puts a sign on suspects,such as mental progression,adjusting the range and intensity of light and relief atmosphere by giving something.Investigation activity should instill in suspect＇s heart and get through his consciousness.Such as normative behavior,shaking hands with a hint and keeping eye contact.Other relative mental skills such as associative reaction,letting suspect retell,deleting and completing words and free talking are aimed at spying and controlling suspect＇s psychology.During the volitional and emotional confrontation,there are some limited conditions in empirical of interrogation technology,art of investigation strategy and adoptability of confession and investigator should adjust it flexibly.
