浅论检察环节的非法证据排除——兼评王玉雷案

Illegal Evidence Exclusion in Procuratorial Proceeding——Comment on the Case of WANG Yu-lei

从王玉雷案中可见,在检察环节落实非法证据排除规则对于检察官落实客观义务、检察机关实现法律监督以及公诉权引导侦查权具有重要的意义。但是,在中国当前的司法制度下,基于检察机关冲突的角色定位、公检之间错位的关系、检察机关"权责不一致"以及检察官缺乏客观义务的理念等多方面的原因,非法证据排除规则在检察环节尚未得到充分和有效的落实。针对上述问题提出了若干建议,以期促进非法证据排除在检察环节得到更好的落实。

Analyzing the case of sion in implem the procuratorial proceeding WangYu-lei finds that the implementation of the illegal evidence excluis of great significance to realize the prosecutors＇ objective obligation, ent the legal supervision and guide the investigation. But in China＇s current judicial system,because of the prosecutors＇ conflicting roles, the relationship between the procurator and the police, procurators ＇ ＂inconsistent responsibilities＂and their lack of the concept about objective obligations,the exclusionary rule of illegal evidence has not yet been implemented fully and effectively in the procuratorical proceeding. Aiming at the problem,the author puts forward some suggestions in order to promote the implementation of the illegal evidence exclusion.
