摘要
对劳动关系属性的认识,不能仅从劳动者与雇主之间的关系去认识,而应从劳动价值实现过程中形成的社会关系去分析。这就需要从宪法的视角,即从国家在劳动价值实现过程中的作用去分析劳动关系。在这个过程中,国家因其不干预、积极干预以及直接提供实体性保障的不同作用,形成了不同性质的劳动关系。相应地,宪法视野下的劳动权也是一个以劳动自由权为主、以国家保护性义务与劳动社会权为补充的立体式的结构。
In realizing the value of labor, the role of the state plays three kinds of functions, including noninter- vention, positive intervention, and directly providing substantive protection. In this process, the nature of labor relations is different, and the structure of labor right is also developed from the single labor fight to the fight of labor freedom as the main, the state protection obligation and social fights as the complement.
