法治社会视野下公民法治意识的生成条件

Conditions for Generating Citizens' Consciousness of Rule of Law under the Field of Society with Rule of Law

公民较高的法治意识是推进法治社会建设的基础性条件。法治社会必然要求公民把法治作为一种生活方式,把尊法守法作为一种行为自觉和道德自觉。然而,中国的法治建设是在缺乏法治传统的情况下开启的,促进公民养成法治习惯、形成法治思维、生成法治意识必将是一项长期性的基础工作。而要促进公民法治意识生成,就必须首先研究对公民法治意识生成有决定影响的关键因素。概括而言,法律本身的科学良善与法律的有效实施、国家法治实践与法治教育、社会道德氛围与市场经济以及个体的人格健全与法律认知等涉及制度、国家、社会和个体方面的因素对公民法治意识生成都有着重要促进作用。

Higher citizens’ sense of rule of law is the basic condition to promote the construc-tion of the rule of law. Rule of law society is bound to require citizens to take the rule of law as a way of life, respect the law as a kind of behavior and moral consciousness. However, the con-struction of China＇s rule of law started in the absence of the tradition of rule of law. It is bound to be a long-term fundamental task to promote citizens to develop the rule of law habits, to form the rule of law thinking,and the rule of law awareness. To promote the rule of law,we must first study the key factors that affect the formation of the rule of law. Generally, what are of great im-portance in promoting the development of citizen’ s legal sense are the factors involved in system, nation, society and individual, such as the scientific and kind nature of law itself and its effective implementation, the national legal practice and legal education, social morality atmosphere and market-oriented economy, and sound personality of each person and his legal cognition.
